In september 2016 stemde de Tweede Kamer in met een voorgestelde wijziging van de Arbowet die per 1 juli 2017 zal gaan. In deze nieuwe wet, waar een grotere nadruk komt te liggen op veilig en gezond werken, is een grotere rol weggelegd voor de OR. Zo gaat de OR de keuze en de positie van de preventiemedewerker mede bepalen en krijgt de bedrijfsarts het recht om te overleggen met de OR. Sinds 2005 moet elke organisatie ten minste één preventiemedewerker hebben. Dit is vaak een vaste medewerker die deze functie / taak naast zijn normale werkzaamheden uitvoert.
Er bestaat (nog?) geen verplichte opleiding voor deze preventiemedewerker.
Bij de invoering van de vernieuwde Arbowet krijgt de OR instemming over de aanstelling van de preventiemedewerker. Dat verplicht tevens de werkgever om aan te geven wat de taken en bevoegdheden van de preventiemedewerker zijn. De wet zelf zegt over de taken van de preventiemedewerker het volgende:
- Het (mede) opstellen en uitvoeren van de risico -inventarisatie en –evaluatie (RI&E);
- Het adviseren en nauw samenwerken met de OR over de te nemen maatregelen voor een goed Arbobeleid;
- Deze maatregelen (mede)uitvoeren.
Aangezien Arbo onder artikel 27 van de WOR valt heeft de OR dus instemming over:
- Het instrument dat het bedrijf wil inzetten om de RI&E uit te voeren;
- De Arbodienst of Arbodeskundige die wordt betrokken bij het toetsen van de RI&E
- De getoetste RI&E en het plan van aanpak;
- Het bijstellen van de RI&E (wanneer hij wordt geactualiseerd) en het plan van aanpak;
Over de RI&E
Alle ondernemers met personeel zijn verplicht om de gezondheids- en veiligheidsrisico’s te inventariseren en te evalueren. Als de lijst met risico’s compleet en actueel is, moet de ondernemer in een plan van aanpak aangeven welke maatregelen hij zal nemen om die risico’s terug te dringen.
De OR heeft nu dus al een grote verantwoordelijkheid als het gaat om gezond en veilig werken en bij de invoering van de nieuwe Arbowet komen daar dus nog meer verantwoordelijkheden bij! Zo moet de ondernemer instemming vragen aan de OR wanneer hij een nieuwe (basis of basisplus-) contract wil afsluiten met een Arbodienst. De nieuwe Arbowet schrijft onder andere voor welke onderwerpen er ten minste in dit contract moeten worden afgesproken. Verplicht is in ieder geval:
- Dat de bedrijfsarts toegang heeft tot elke werkplek;
- Op welke manieren de Arbohulpverlener of bedrijfsarts zijn wettelijke taken kan uitvoeren;
- Hoe de toegang tot de bedrijfsarts en het overleg met de preventiemedewerker geregeld is;
- Hoe de werknemers gebruik kunnen maken van het recht op second opinion;
- Hoe de klachtenprocedures werken;
- Hoe de bedrijfsarts omgaat met de meldingsplicht voor beroepsziekten.
